What is inappropriate Financial Advice?

If you have sought advice from financial advisor you are entitled to expect that the advice has been given with skill and care. Your financial advisor must have a reasonable basis for the advice and ensure that the advice which is recommended is suitable for your personal circumstances, goals and objectives. This includes understanding the level of risk that you as an investor are willing to take. If your financial advisor has failed to take into account one or more of these factors the advice could be considered to be inappropriate. There are also many other potential circumstances where the advice could be considered to be inappropriate, including:

  • Negligent investment strategies which were not suitable for a client’s goals and objectives;
  • Misleading statements as to the risks inherent with a financial product;
  • Misleading prospectus as to the nature of an investment;
  • An advisor failing to comply with a client’s instructions; and/or
  • Aggressive trading and “churning” of accounts for brokerage.

What do we need to consider your claim?

The first step in the investigation process is to obtain documents from the investor which identifies the nature of the investments and the monetary value of the loss alleged to have been suffered. In our experience the following key documents are required to consider the claim:

  • Investment statements;
  • Application forms;
